Small Estate Transfer of Personal Property - $200 + court filing fees

This option is for estates valued at under $75,000, excluding real property. By filing a small estate affidavit, we can avoid the probate process and allow the decedent’s heirs to transfer property without the need for court involvement. Our fee is a set service fee covering the entire process, and is charged in addition to any court filing fees that will be incurred.

Small Estate Transfer of Real Property - $300 + court filing fees

This option is for real property valued at under $100,000. A small estate affidavit bypasses the probate process, giving the decedent’s heirs the authority to transfer property without the need to open a probate case. Our fee is a set service fee covering the entire process, and is charged in addition to any court filing fees that will be incurred.

Informal Probate Process - $700 + court filing fees

This option is for estates with real and personal property valued at over $75,000 and over $100,000, respectively. An informal probate differs from a formal probate in that very little court involvement is required in an informal probate proceeding. In order to qualify for informal probate, the following conditions must be present:

  1. The estate must be uncontested.
  2. The decedent must have a valid, self-proving will. 
  3. If there is a personal representative named in the will, that personal representative must be allowed to serve without bond. 

In most cases, a court appearance is not required, and the personal representative is authorized to act independently upon receiving court appointment paperwork. We will walk you through the process of opening and closing a non-probate case, and handle all the paperwork, notice, filing and publishing throughout the proceedings. Our fee is a flat rate, which we collect in addition to the court filing fees in your county.

Do you qualify for a waiver or deferral of your court filing fees?

You may qualify if:

  • Your income or the estate’s income is insufficient or barely sufficient to meet the daily essentials of life, and includes no allotment that could be budgeted for the fees and costs that are required to gain access to the court. Your gross income is 150% or less of the current federal poverty level.
  • You do not have the money to pay court filing fees now, but can pay at a later date (explanation required).
  • Your income is greater than 150% of the poverty level, but you have proof of extraordinary expenses.
  • You receive governmental assistance from the Federal Supplemental Security Income (SSI) program. 

If any of these apply, we can apply for a deferral or waiver of your fees on your behalf with the court.
